Terms of Service

These Terms of Service govern your engagement with RCG Creative (“RCG Creative,” “we,” “us,” or “our”) for creative services including video production, photography, brand design, and web development. By engaging our services, you agree to these terms.

Specific project terms — including deliverable scope, revision rounds, timeline, and pricing — are defined in your individual project agreement or proposal. In the event of a conflict, the project agreement takes precedence over these general terms.

Services

RCG Creative provides creative services on a project basis. All work is scoped and agreed upon prior to commencement. We reserve the right to decline any project at our discretion.

Payment

A deposit is required before work begins. The specific deposit amount is outlined in your project agreement (typically 50% of the total project fee). The remaining balance is due before final files are delivered. Work product will not be released until payment is received in full.

Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance.

Revisions

Each project includes a defined number of revision rounds as specified in your project agreement. Revisions beyond the included rounds are billed at our current hourly rate. Revision requests must be submitted within 14 days of delivery; requests received after this period may be treated as new work.

Intellectual Property

Client ownership. Upon receipt of full payment, the client receives ownership of the final deliverables as specified in the project agreement. “Final deliverables” refers to the agreed-upon output (e.g., exported video files, final logo files, live website) — not the underlying raw assets, working files, or source materials unless explicitly agreed in writing.

Portfolio rights. RCG Creative retains the right to display completed work in our portfolio, website, and promotional materials unless the client requests otherwise in writing prior to project commencement.

Third-party materials. The client is responsible for ensuring they have proper rights to any materials (logos, images, music, footage) provided to us for use in their project.

Confidentiality

We treat all client information, project details, and materials as confidential and will not disclose them to third parties without your consent, except as required to deliver the services (e.g., sharing project files with collaborators under NDA).

Cancellation

If you cancel a project after work has begun, you forfeit the deposit and are responsible for payment of any work completed to date at our hourly rate. If RCG Creative cancels a project for any reason, any amounts paid beyond work completed will be refunded.

Limitation of Liability

To the fullest extent permitted by applicable law, RCG Creative’s total liability for any claim arising from our services is limited to the amount paid by the client for the project in question. We are not liable for indirect, incidental, or consequential damages.

Warranties

We warrant that our work is original and, to the best of our knowledge, does not infringe on any third-party intellectual property. We make no other warranties, express or implied, including warranties of fitness for a particular purpose.

Governing Law

These terms are governed by the laws of the applicable jurisdiction as agreed in your project agreement. Any disputes will be resolved through good-faith negotiation before escalating to legal proceedings.

Changes to These Terms

We may update these terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued engagement with our services after a revision constitutes acceptance of the updated terms.
